HIPAA Notice of Privacy Practices

Effective date: October 5, 2026

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

This notice applies to LisaCare Psychiatry and Wellness, including Prisca Oketch, APRN PMHNP-BC, and its workforce. LisaCare is required by law to maintain the privacy and security of protected health information ("PHI"), provide this notice of our legal duties and privacy practices, and follow the notice currently in effect.

Your rights

When it comes to your health information, you have certain rights. LisaCare has responsibilities to help you exercise them.

Get an electronic or paper copy of your record

You may ask to see or receive an electronic or paper copy of your medical record and other health information LisaCare maintains about you. We will explain how to make the request. We generally will provide a copy or summary within 30 days and may charge a reasonable, cost-based fee as permitted by law.

Ask us to correct your record

You may ask us to correct health information that you believe is incorrect or incomplete. We may deny a request in circumstances allowed by law, but we will explain a denial in writing, generally within 60 days.

Request confidential communications

You may ask us to contact you in a particular way or at a different address. We will accommodate reasonable requests.

Ask us to limit what we use or share

You may ask us not to use or share certain information for treatment, payment, or health care operations. We are not always required to agree. If you pay in full out of pocket for an item or service, you may ask us not to disclose information about that item or service to your health plan for payment or health care operations; we will agree unless the law requires the disclosure.

Receive an accounting of disclosures

You may ask for a list of certain disclosures of your health information made during the six years before your request, including who received it and why. The accounting does not include disclosures for treatment, payment, or health care operations and certain other disclosures. One accounting in a 12-month period is free; a reasonable, cost-based fee may apply to additional requests.

Receive a copy of this notice

You may ask for a paper copy at any time, even if you agreed to receive it electronically.

Choose someone to act for you

If a person has legal authority to act as your personal representative, such as through a medical power of attorney or guardianship, that person may exercise your rights and make choices about your information. We will verify that authority before acting.

File a complaint

You may complain to LisaCare if you believe your privacy rights were violated. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by writing to 200 Independence Avenue SW, Washington, DC 20201, calling 1-877-696-6775, or using the HHS complaint page. LisaCare will not retaliate against you for filing a complaint.

Your choices

In some situations, you may tell us your preferences about sharing information, including sharing with family, close friends, others involved in your care or payment for care, or disaster-relief organizations. If you cannot tell us your preference, we may share information when we believe it is in your best interest or when needed to lessen a serious and imminent threat to health or safety, as permitted by law.

We generally need your written authorization for:

  • most uses and disclosures of psychotherapy notes;
  • marketing purposes;
  • a sale of PHI; and
  • uses and disclosures not otherwise described in this notice.

You may revoke an authorization in writing, except to the extent we already relied on it.

If LisaCare conducts fundraising and contacts you, you may tell us not to contact you again. If a fundraising communication would use substance use disorder patient records protected by 42 CFR Part 2, LisaCare will provide clear and conspicuous advance notice and an opportunity to opt out.

How we typically use and share information

Treatment

We may use and share your information with other health professionals who are treating you, such as a primary-care clinician, therapist, pharmacy, laboratory, or another treating provider.

Payment

We may use and share your information to bill and obtain payment from you, a health plan, or another entity responsible for payment.

Health care operations

We may use and share your information to operate the practice, coordinate services, improve care, conduct quality activities, manage business functions, and contact you when necessary. Service providers that qualify as business associates are required to protect PHI as required by applicable law and contract.

Other uses and disclosures permitted or required by law

Subject to legal conditions and limits, LisaCare may use or disclose PHI to:

  • prevent disease, report adverse events, report suspected abuse, neglect, or domestic violence, or address other public-health and safety activities;
  • reduce a serious and imminent threat to a person or the public;
  • conduct health research when legal requirements are met;
  • comply with federal or state law, including review by HHS for HIPAA compliance;
  • respond to organ and tissue donation requests;
  • work with a coroner, medical examiner, or funeral director after a person dies;
  • address workers' compensation matters;
  • respond to health-oversight, law-enforcement, military, national-security, protective-service, or other authorized government requests; and
  • respond to a court or administrative order, subpoena, or other judicial or administrative process as permitted by law.

Federal and state laws may provide greater protection for mental-health, substance-use-disorder, HIV, genetic, reproductive-health, minor, or other sensitive information. LisaCare will apply the more protective requirement when it governs a use or disclosure.

Substance use disorder records protected by 42 CFR Part 2

To the extent LisaCare receives or maintains substance use disorder patient records protected by 42 CFR Part 2, those records receive additional protection. LisaCare will not use or disclose those records in a civil, criminal, administrative, or legislative investigation or proceeding against the patient without the patient's written consent or both a court order and a subpoena, as required by law. Other Part 2 restrictions and permissions also apply.

Our responsibilities

LisaCare is required to:

  • maintain the privacy and security of PHI;
  • notify affected individuals promptly following a breach of unsecured PHI when the law requires notice;
  • follow the duties and privacy practices described in the notice currently in effect; and
  • refrain from using or sharing PHI other than as described here unless you authorize it in writing or the law otherwise permits or requires it.

Changes to this notice

LisaCare may change this notice and make the revised terms apply to PHI already maintained as well as information received in the future. A current notice will be posted on the website and will be available on request.
